“CHILL MY RIDE” PROMOTION

 HOW TO ENTER
  1. To be eligible to enter, individuals must purchase any specially marked Chill product (excluding 300ml Chill products) between 1 October 2007 and 11 January 2008 (the promotional period) and locate the entry code found inside cartons or the barcode number on bottles.
  2. To enter, entrants must then either:

    (a) enter online by visiting www.chillmyride.com.au, follow the prompts to the competition entry page, input the requested details including the entry code (from cartons) or the last four digits of the product barcode (from bottles) and submit the fully completed entry form;

    OR

    (b) send an SMS to 1999 5225 containing the entry code (from cartons) or the last four digits of the product barcode (from bottles), followed by their full name and post code;

    during the promotional period.

    Premium SMS cost is 55c. Entrants must have premium service access.
 TERMS AND CONDITIONS
  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to NSW, WA and QLD residents. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent or guardian, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. Incomplete, indecipherable, or illegible entries will be deemed invalid. Unrecognised entry codes or barcodes will not be accepted.
  5. Multiple entries permitted, subject to the following: (a) only one entry permitted per carton or bottle (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of five entries is permitted per entrant per day. Entrants must retain the entry code or barcode from each carton or bottle used by them to enter this promotion. Failure to produce each entry code or barcode when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize.
  6. If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the mobile phone/internet account is held.
  7. Premium SMS cost is 55c. Entrants must have premium service access. Service provider: Prime Focus. SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
  8. Promotion commences on 1 October 2007. Entries close 11:59pm AEDST on 11 January 2008. The draw will take place at Prime Focus, Suite 104, 55 Beach Street, Port Melbourne Vic 3207 on 16 January 2008 at 2pm AEDST. Instant winners will be notified immediately and in writing according to their entry method: (a) SMS – via return SMS; or (b) online – on the website upon entry submission. Winners will be notified by mail and their names will be published in The Australian on 4 February 2008.
  9. The Promoter’s decision is final and no correspondence will be entered into.
  10. Major Prize Draw: All winning and non-winning instant win entries will be entered into the major prize draw. The first valid entry drawn will win a 2007 Hummer H3 with luxury automatic 4wd transmission in black with light cashmere interior. The prize will also include up to $2,000 worth of additional Hummer accessories, up to $2,000 worth of non-standard accessories and a $1,000 fuel voucher. The Promoter will liaise with the winner to arrange accessories to be chosen by the winner, subject to availability, up to the maximum values stated. Fuel voucher will be issued by the fuel outlet nominated by the Promoter in its sole absolute discretion. Prize value is up to $71,907 including all compulsory insurance, on road costs (which may vary State by State) and dealer delivery. Additional insurance, additional accessories and options, additional petrol and all other ancillary costs are the responsibility of the winner. Any ancillary costs associated with redeeming the fuel voucher are not included. Any unused balance of the fuel voucher will not be awarded as cash. Redemption of the fuel voucher is subject to any terms and conditions of the issuer including those specified on the fuel voucher.
  11. Instant Win Prizes: There will also be 50 x branded Cruisin’ Cooler Motorised Ice Boxes valued at $495.00 each to be won instantly throughout the promotion.
  12. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
  13. Subject to the unclaimed prize draw clause, if for any reason a winner does not take an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
  14. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  15. Total prize pool value is $96,657.
  16. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  17. A draw for any unclaimed prizes may take place on 21 May 2008 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published in The Australian on 2 June 2008.
  18. Unless otherwise due to fraud or ineligibility under these terms and conditions, all claims to prizes in excess of the advertised prize pool will be honoured. Printing errors or other quality control matters outside the control of individual entrants shall not be used as the sole basis for refusing to award a prize.
  19. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  22. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  23. Promotional materials void if stolen, forged, mutilated or tampered with in any way.
  24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize
  25. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
